Résumé : In just over half a century, Europe has come a long way towards equal treatment on the grounds of sexual orientation. The two European Courts have played a major role in this process, often as a result of strategic lawsuits initiated by transnational NGOs. This paper explores the case law of the two European courts and divides it into two parts. The first one focuses on the developments that have led to ending the criminalization of same-sex relationships, but also to condemning mechanisms of exclusion from the public space which are also found in access to employment. The second part deals with developments in European jurisprudence regarding the legal recognition of same-sex couples, as well as the resulting family and social rights.
